Terms of Service

1. These terms

These terms of service cover the UHost software, this website, your account at my.uhostpanel.com, UHost's licence and release service at license.uhostpanel.com, and our support. "UHost", "we" and "us" mean UHost Panel, the business that makes and sells UHost. "You" means the person or organisation using it.

By creating an account, applying a licence key or paying for a plan, you agree to these terms, our refund policy and our privacy policy. If you accept them for an organisation, you confirm that you may do so on its behalf.

2. Your account

• Give a real name and an email address you read. We use it for your licence, your bills and your support tickets.
• Keep your password and authenticator safe. You are responsible for what is done with your account, including by the people you invite to it, who act with the access you give them.
• If you think somebody else has got into your account, tell us at support@uhostpanel.com straight away.
• You must be old enough to enter a binding contract where you live.

3. Plans and licences

UHost is licensed, not sold. Free is the whole panel for up to three websites, with no key, no account and no time limit. Pro is unlimited websites on one server. Business is unlimited websites on every server you or your organisation runs, with one licence key.

A paid plan gives you a non-exclusive, non-transferable licence to use UHost on the servers it covers for as long as it is paid for, including to host websites for your own customers. You may not share or sell a licence key, use one on servers another organisation runs, get around a plan's limits, its licence checks or the signatures on updates, or resell UHost licences without a written agreement with us.

API tokens, for scripts and integrations, come with Pro and Business. If a licence ends, the server goes back to the free plan: every website, mailbox and DNS zone it hosts keeps running, UHost does not create websites past the free plan's limit, and API tokens stop working until a licence is applied again. Nothing is deleted.

4. Your servers and what you host

UHost runs on servers you control. We do not host your websites and cannot see what they contain. You are responsible for your servers, for what they host and send, for the people you give access to, and for following the laws that apply to them.

You are also responsible for your backups. UHost includes backup tools, but you decide where copies are kept and whether they are tested. What a UHost server sends us is set out in our privacy policy.

5. Updates

Every plan, the free one included, is offered every release, security fixes included. An update installs only when an administrator chooses to install it, and it is refused unless it carries UHost's signature. Features may be added, changed or removed between releases, but a paid plan does not lose what it was sold with during a month you have already paid for.

6. Paying

• Prices are in US dollars, per month, paid in advance. No tax is added today. If we have to charge tax, we will tell you before it applies.
• You pay by card on Stripe's own checkout page. UHost never sees or stores your card number.
• A plan renews each month on the day you first paid, until you cancel, and Stripe charges the card on file.
• If a renewal payment fails, Stripe tries the card again and we email you. Your licence keeps working until the end of the month you paid for, plus three days. If no payment arrives by then, the server goes back to the free plan.
• Prices can change. We email you at least 30 days before a new price applies to you. It starts at your first renewal after that, and you can cancel before then.

7. Upgrading and downgrading

You can upgrade from Pro to Business at any time from your service page. You pay the difference for the rest of the month you have already paid for straight away, and your renewal date stays the same. To move from Business to Pro, write to us, and the change applies from your next renewal.

8. Cancelling

Cancel at any time from your service page, and nothing more is charged. Your plan keeps working until the end of the month you paid for. After that the server goes back to the free plan and every website keeps running. Cancelling does not refund the rest of that month, except where our refund policy says so. To close your account altogether, write to hello@uhostpanel.com.

9. Refunds

Pro and Business come with a 30-day money-back guarantee on your first payment, and a renewal you did not mean to keep is refunded if you ask within 7 days of it. The details, and how to ask, are in our refund policy.

10. Support

Pro and Business include support. Open a ticket from your account at my.uhostpanel.com, or write to support@uhostpanel.com.

• Hours, in Atlantic time: Monday to Friday, 9am to 5pm, and Saturday and Sunday, 10am to 4pm, except on holidays we announce in advance.
• First reply: within 24 hours on Business and within 48 hours on Pro, counted from when you open the ticket. Weekends count; announced holidays do not. The target is for a reply from a person, not an automatic acknowledgement, and it is not a promise that the problem is solved in that time.
• What support covers: installing, configuring, updating and using UHost, problems caused by UHost, and your licence, account and bills. Business also includes hands-on help moving your websites from your old panel into UHost.
• What it does not cover: writing or fixing your websites or applications, running your servers for you, or problems outside UHost, such as your hosting provider's network or another application's own bugs. We will still tell you what we can see.
• The free plan comes with the install guide and the answers on this site. Anybody can write to us about billing, their account or a security problem.

Reply targets are what we commit to, not a scheme of service credits.

11. Using our services fairly

Do not attack, overload or probe this website, my.uhostpanel.com or license.uhostpanel.com beyond ordinary use, use them to break the law, or harass anybody, our staff included. If you find a security problem, write to support@uhostpanel.com with "Security" in the subject, and give us the chance to fix it before telling anyone else.

12. Suspending or ending a licence

We may suspend or end a licence or an account that seriously or repeatedly breaks these terms, for example by sharing a licence key, not paying, or attacking our services. Where we reasonably can, we warn you first and give you time to put it right. A suspended or ended licence returns the server to the free plan, so your websites keep running.

13. Availability

We work to keep uhostpanel.com, my.uhostpanel.com and license.uhostpanel.com running, but we cannot promise they are never unavailable. A problem with our services never stops the websites your servers host.

14. Warranty

We build UHost carefully and fix the problems in it we find or are told about. Beyond that, and as far as the law allows, UHost and our services are provided as they are, without any other promise, including that they suit a particular purpose or are free of errors.

15. Limits on liability

As far as the law allows, we are not liable for indirect or consequential losses, such as lost profits, revenue, data or business, and our total liability for any claim is limited to what you paid us for UHost in the 12 months before it arose. Nothing in these terms limits a liability the law does not allow to be limited, or takes away a right you have as a consumer that cannot be given up.

16. Changes to these terms

When these terms change, so does the date at the top of this page. For a change that matters to paying customers, we email you at least 30 days before it applies, and if you do not agree you can cancel before then. Using UHost after a change applies means you accept it.

17. Law

These terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada that apply there, and the courts of Nova Scotia may settle any dispute about them, unless the law where you live gives you the right to use your own courts.
